DCMA Policy

At Just Simply Well (“we,” “us,” or “our”), we respect the intellectual property rights of others and expect our users to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how we handle copyright infringement notifications in compliance with the U.S. Digital Millennium Copyright Act (17 U.S.C. §512).

1. Reporting Copyright Infringement

If you believe that material available on or through JustSimplyWell.com infringes one or more of your copyrights, please send a written DMCA notice to our designated Copyright Agent with the following information:

3. Removal of Infringing Content

Upon receiving a valid DMCA notice, we will:

  • Review the claim,
  • Remove or disable access to the allegedly infringing material, and
  • Notify the individual who posted the material of the removal.

If appropriate, we may also terminate accounts or access of repeat infringers.

4. Counter-Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification.
Your counter-notice must include:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or disabled, and the location where the material appeared before it was removed;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in your area, or if outside the United States, to a court of proper jurisdiction, and that you will accept service of process from the person who provided the original DMCA notice.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Just Simply Well may, in appropriate circumstances, terminate access to users who are found to be repeat infringers of copyrighted material.

6. Modifications

We reserve the right to modify or update this DMCA Policy at any time without prior notice. Any updates will be posted on this page and indicated by the “Last Updated” date above.
